Terms of Service

1. Agreement to Terms

By accessing or using PushNotice (“the Service”), operated by Sajid Ali at pushnotice.io, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

2. Description of Service

PushNotice is a SaaS platform that enables businesses to create, distribute, and manage digital wallet passes for Apple Wallet and Google Wallet. Features include pass creation, QR code generation, customer management, campaign management, and push notifications delivered via Apple Push Notification Service (APNs) and Google Wallet API.

3. Account Registration

You must create an account to use the Service. You agree to provide accurate, current, and complete information and to keep your account credentials secure. You are responsible for all activity that occurs under your account. You must be at least 18 years old to use the Service.

4. Subscriptions and Billing

PushNotice offers subscription plans billed on a monthly or annual basis. Payments are processed by Paddle.com Market Limited, which acts as the Merchant of Record. By subscribing, you also agree to Paddle's Terms of Use available at paddle.com/legal/terms.

  • Subscriptions automatically renew at the end of each billing period unless cancelled.
  • You may cancel your subscription at any time from your account settings.
  • Cancellation takes effect at the end of the current billing period — you retain access until then.
  • Prices are listed in USD and may be subject to applicable taxes depending on your location.

5. Acceptable Use

You agree not to use PushNotice to:

  • Send spam, unsolicited, or harassing push notifications
  • Distribute malware or any harmful content via wallet passes
  • Violate any applicable laws or regulations
  • Impersonate any person or entity
  • Collect data from end-users without their consent
  • Reverse engineer, decompile, or attempt to extract our source code
  • Resell or sublicense the Service without written permission

6. Your Data and Content

You retain ownership of all data and content you upload to PushNotice (business information, customer data, pass designs, logos). By using the Service, you grant us a limited licence to store and process this data solely to provide the Service to you. You are responsible for ensuring you have the right to upload and use all content and customer data, including obtaining appropriate consent from your end-users.

7. Apple and Google Wallet Compliance

You are responsible for ensuring your wallet passes comply with Apple's Wallet Human Interface Guidelines and Google Wallet's policies. PushNotice is not affiliated with Apple Inc. or Google LLC. “Apple Wallet” and “Google Wallet” are trademarks of their respective owners.

8. Intellectual Property

The PushNotice platform, including its software, design, and content, is owned by Sajid Ali and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the platform without our written consent.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Push notification delivery depends on third-party services (Apple APNs, Google Wallet) and cannot be guaranteed.

10. Limitation of Liability

To the maximum extent permitted by law, Sajid Ali and PushNotice shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any conduct we deem harmful to the Service or other users. You may terminate your account at any time by contacting us or cancelling via account settings.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the platform. Continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through binding arbitration or in a court of competent jurisdiction.
